    Minutes                                                                                                               December 12, 2024   Public Hearing #1 - Charter Amendment The City of Winterville, acting by and through the Mayor and City Council of Winterville, desires to amend of the Charter of the City of Winterville pursuant to its authority conferred by the Constitution and the Laws of Georgia. The purpose of this amendment is to allow the City of Winterville to grant licenses to sell distilled spirits within the City of Winterville. Therefore, the Mayor and City Council of Winterville propose that Section 25 of the Charter of the City of Winterville be amended to delete the following from Section 25 in its entirety: The Mayor and City Council shall forever be prohibited from granting licenses or permits in any form to anyone to sell distilled spirits within the City of Winterville. The Mayor and City Council shall be authorized to grant licenses or permits to persons to sell or manufacture malt beverages or wine within the City of Winterville in accordance with the laws of the State of Georgia and any rules, regulations and ordinances enacted by the City of Winterville. And to substitute the following words in lieu thereof: The Mayor and City Council shall be authorized to grant licenses or permits to persons to sell or manufacture malt beverages, wine or distilled spirits within the City of Winterville in accordance with the laws of the State of Georgia and any rules, regulations and ordinances enacted by the City of Winterville. Any portion of that Charter in conflict with this ordinance amending the Charter of the City of Winterville will be repealed upon final adoption of the amending ordinance. Public Hearings on the ordinance amending the Charter of the City of Winterville will be held at the Mayor and City Council’s regular meetings on November 12, 2024 and December 10, 2024 which will be held at Winterville City Hall, 125 N. Church Street, Winterville, Georgia 30683. A copy of this ordinance is on file with the Winterville City Clerk and the Clerk of Superior Court of Athens-Clarke County for purposes of examination and inspection by the public. A copy of the proposed amendment is available upon written request to the Winterville City Clerk, Wendy Bond, 125 N. Church Street, P.O. Box 306, Winterville, GA 30683. Mayor Ferrelle opened the public hearing at 6:00 pm. No public signed up to speak, therefore, he closed the meeting at 6:02 pm. Public Hearing #2 – Code Amendment – Special Use: Composting The Mayor and City Council will hold a public hearing on December 10, 2024 at 6:00 pm at Winterville City Hall at 125 North Church Street, Winterville, Georgia 30683 to consider revisions to the zoning ordinances of the City of Winterville, Georgia to allow Composting as a Special Use in Rural Residential and Residential Single-Family zoning districts. All those having an interest in said ordinance should be present. Mayor Ferrelle opened the Public Hearing at 6:02 pm. No public signed up to speak. He closed the hearing at 6:03 pm. The Mayor and City Council held their regular City Council meeting on Tuesday December 12, 2024 at 6:00 pm at Winterville City Hall. Attendees: Mayor Dodd Ferrelle, Bruce Johnson, Melissa Metzger, Municipal Clerk Wendy Bond and City Attorney David Ellison. Jonathan Mosley was unable to attend. Mayor Ferrelle called the meeting to order at 6:04 pm. The Pledge of Allegiance was recited. Approval of Minutes: Councilperson Metzger moved to approve the minutes of November 12, 2024. The motion was seconded by Councilperson Johnson and approved unanimously. Unfinished Business: None. New Business: The First Item of New Business: Charter Amendment Alcohol by the Drink (2nd Vote). Councilperson Metzger moved to adopt the charter amendment as presented. The motion was seconded by Councilperson Johnson and adopted unanimously. The Second Item of New Business: Code Amendment (Special Use: Composting). Councilperson Johnson moved to approve the Code Amendment for Special Use: Composting as presented. The motion was seconded by Councilperson Metzger and approved unanimously. The Third Item of New Business: City Hall Renovation. Councilperson Johnson moved to approve up to $151,000, (combination of TSPLOST, SPLOST 2020 and General Funds) for the restroom addition and renovations to city hall. The motion was seconded by Councilperson Metzger and approved unanimously. The Fourth Item of New Business: Retreat Notes/POAB for Police Officers. Councilperson Johnson moved to approve contribute $10/per week to the Police Officer’s Annuity & Benefit (POAB) fund on behalf of city employed police officers. The motion was seconded by Councilperson Metzger and approved unanimously. The Fifth Items of New Business: Main Street Garage, New Ownership. No action was taken. P&Z will review, The Sixth Item of New Business: NEGRC Retreat. No action was taken. The Seventh Item of New Business: WCC Gallery Request. Councilperson Johnson moved to deny a prior request for the gallery. Councilperson Metzger seconded the motion and was unanimously denied. The Eighth Item of New Business: Mower Bid Opening. Mayor Ferrell open the sealed bids submitted for the 2 surplus mowers. The winning bid was awarded to David Kirby for a total of $1,118,00. The Ninth Item of New Business: Fox Gives Grant Award Announcement. – Mayor Ferrell announced the city has received the third and final grant from the Fox Theatre Gives program of $58,000.00. No action necessary or taken. Committee Reports: Public Finance (Johnson & Mosley) Clerk Bond has provided financial statements through November 30, 2024. These are available for public review upon request. Public Safety (Metzger & Mosley) Councilperson Metzger gave a verbal report. Fire Department – Chief Michael Gabriel submitted a call report. Police Department – No report. Public Works (Johnson) – Councilperson Johnson gave a brief report. Communications Committee (Metzger) – No report. Winterville Cultural Center –No report.   • Winter Storm Emergency Shelter

    The Winterville Cultural Center, 371 N Church St, will be open as an emergency shelter from 5 p.m. Friday, January 10th until 10 a.m. Saturday, January 11th. If you know ahead of time that you will need to stay at the shelter, please email brucejohnson@gmail.com . You can also just show up in the middle of the night. Someone will be there to let you in. If you have a medical device that needs power, we are prepared for that even if we lose power from the grid. The Cultural Center has a 36 kWh emergency battery backup system that will keep the first floor lights on, the refrigerator running (for food and medications), and power a portable heater if necessary. We will also do our best to accommodate pets. Please bring all supplies needed, including leashes and carriers/kennels. If you need to come to the shelter, please use extreme caution when driving.

    Public Hearing Minutes                                                                           November 12, 2024   Public Hearing #1 - Budget The Winterville City Council held two (2) Public Hearings Tuesday November 5, 2024 at 6:00 pm and Tuesday November 12, 2024 at 6:00 pm, in Winterville City Hall; to receive public input regarding the Proposed City of Winterville Budget for the year 2025. Documents were available for review at City Hall or on the City’s website: www.cityofwinterville.com . Those wishing to address Mayor and Council were required to sign up on a form provided by the city prior to the commencement of the hearing. Mayor Ferrelle opened the Public Hearing at 6:00 pm. Councilperson Metzger moved to appoint Tina Mills as the permanent Director of the Winterville Cultural Center. The motion was seconded by Councilperson Mosley and approved unanimously.   The Fourth Item of New Business: Blacksmith Shop Bid Award.  Councilperson Metzger moved to approve Character Built Construction as the low bidder of $320,474.07 with add alternate pricing of $26,000.00 making the total possible total of $347,028.25, which comes within the $489,000.00 CDBG grant awarded. The motion was seconded by Councilperson Johnson and approved unanimously.   The Fifth Items of New Business: Intersection Improvements Bid Award . Councilperson Johnson moved to approve College Pro Landscaping as the low bidder of $327,730.00 for intersection improvements. The motion was seconded by Councilperson Metzger and unanimously approved.   The Sixth Item of New Business:  WVFD Golf Cart. Councilperson Johnson moved to approve $10,545.00 SPLOST 2020 funds for the purchase of a golf cart from Fat Boy’s Golf Carts. The motion was seconded by Councilperson Mosley and unanimously approved.   The Seventh Item of New Business: Gallery Request.  Councilperson Mosley moved to table this item until further notice. The motion was seconded by Councilperson Johnson and unanimously tabled.   The Eighth Item of New Business: TSPLOST Project Proposals for ACC. Councilperson Metzger moved to approve a list of TSPLOST projects to Athens-Clarke County as presented. The motion was seconded by Councilperson Mosley and unanimously approved.   The Ninth Item of New Business: GMA Franchise Fee Evaluation Project. Councilperson Mosley moved to approve up to $1,050.00 general funds to inter into a one-year agreement with the Georgia Municipal Association to provide franchise compliance with the City. The motion s seconded by Councilperson Metzger and unanimously approved.   The Tenth Item of New Business: Quotes for City Hall Bathroom Project. Councilperson Johnson moved to table this item until further notice. The motion was seconded by Councilperson Metzger and tabled unanimously.   The Eleventh Item of New Business: Decommissioned Police Car Sale. Councilperson Metzger moved to approve the sale of a decommissioned police car to Oglethorpe County for $2,000.00. The motion was seconded by Councilperson Mosley and unanimously approved.   The Twelfth Item of New Business: Charter Amendment Ordinance. Councilperson Mosley moved to adopt the ordinance to amend the Charter. The motion was seconded by Councilperson Johnson and adopted unanimously. (This is the first of two required votes.)   The Thirteenth Item of New Business: Code Text Amendment/Special Use. No action was taken. The motion was seconded by Member Spratlin and approved.   Old Business:    1.         Member Valentine moved to approve a business license application submitted by Luis Martinez,  Foamguard, LLC, 115 Winter Hill Drive. It will be recommended to Mayor and Council for final        approval.   New Business:    1.         Shane Carson, Straight Line Surveying, Inc., 282, 284, & 286 Lakeview Drive  –Member        Field moved to approve a revised plat as presented. The motion was seconded by Member Valentine and passed.   2.         Matthew Osburn, 288 N Georgia Avenue – Matthew Osburn submitted an application for short term rental of his personal home. Member Valentine move to approve the application as presented. The motion was seconded by Member Field and passed.   3.         Tom and Tish Santosky, 201 & 207 S Church Street – Mr. and Mrs. Santosky came before the committee to inform them of the progress of demolition of 201 S Church Street and the restoration of 207 S Church Street. They are awaiting the results of asbestos testing on the   structures and how to proceed. No action was taken.   4.         Short Term Rental Ordinance Language – The Committee discussed language to amend the zoning ordinance to include the following: a.         Proof of rental property insurance. b.         A drawing or plat that shows designated parking areas for renter’s vehicles and number allowed.           c.         A drawing of showing where renters will be allowed on the property, this should be posted inside the designated rental space. d.         Any pets, owner or renter, should be secured within the property by proper fencing or a designated area. 5.         The Committee discussed the rezone application from Todd Pulliam.               The committee is requesting conditions to be set upon the rezoning of the property prior to the issuance of a business license. 1.  No outdoor burning (Athens-Clarke County has a county-wide burn ban year-round.) 2.  The business would remain as-is, where-is, and not be used as any other business.            3. Documents are available for review at City Hall or on the City’s website: www.cityofwinterville.com . Those wishing to address Mayor and Council are required to sign up on a form provided by the city prior to the commencement of the hearing.   Public Hearing #2 – Charter Amendment  The City of Winterville, acting by and through the Mayor and City Council of Winterville, desires to amend of the Charter of the City of Winterville pursuant to its authority conferred by the Constitution and the Laws of Georgia.  The purpose of this amendment is to allow the City of Winterville to grant licenses to sell distilled spirits within the City of Winterville.  Therefore, the Mayor and City Council of Winterville propose that Section 25 of the Charter of the City of Winterville be amended to delete the following from Section 25 in its entirety: The Mayor and City Council shall forever be prohibited from granting licenses or permits in any form to anyone to sell distilled spirits within the City of Winterville.  The Mayor and City Council shall be authorized to grant licenses or permits to persons to sell or manufacture malt beverages or wine within the City of Winterville in accordance with the laws of the State of Georgia and any rules, regulations and ordinances enacted by the City of Winterville. And to substitute the following words in lieu thereof: The Mayor and City Council shall be authorized to grant licenses or permits to persons to sell or manufacture malt beverages, wine or distilled spirits within the City of Winterville in accordance with the laws of the State of Georgia and any rules, regulations and ordinances enacted by the City of Winterville. Any portion of that Charter in conflict with this ordinance amending the Charter of the City of Winterville will be repealed upon final adoption of the amending ordinance.   Public Hearings on the ordinance amending the Charter of the City of Winterville will be held at the Mayor and City Council’s regular meetings on November 12, 2024 and December 10, 2024 which will be held at Winterville City Hall, 125 N. Church Street, Winterville, Georgia 30683.  A copy of this ordinance is on file with the Winterville City Clerk and the Clerk of Superior Court of Athens-Clarke County for purposes of examination and inspection by the public.  A copy of the proposed amendment is available upon written request to the Winterville City Clerk, Wendy Bond, 125 N.
