City of Winterville Tuesday March 28, 2023 5:30 p.m. – Winterville City Hall Called Meeting Minutes The Winterville City Council conducted a Called Meeting Tuesday, March 28, 2023 at Winterville City Hall 5:30 p.m. to vote to approve an intergovernmental agreement with the Athens-Clarke County Tax Commission to allow ACC to continue collecting taxes for the City of Winterville. Mayor Ferrelle called the meeting to order at 5:30 p.m. Also in attendance were Amanda Mooney, Bruce Johnson, and Melissa Metzger (via phone) and City Clerk Wendy Bond. Councilperson Mooney moved to approve the intergovernmental as presented. The motion was seconded by Councilperson Johnson and approved unanimously. No other business was discussed. Councilperson Johnson moved to adjourn at 5:32 p.m. The motion was seconded by Councilperson Mooney and adjourned unanimously.

Winterville Planning and Zoning Commission Winterville City Hall Winterville, GA 30683 Public Hearing & Regular Meeting Monday February 6, 2023 - 5:30 PM Members Present: David Watwood, Chairman Randy Halstead Andy Dawson Collin Field Kim Burch Regular Meeting: Chairman Watwood called the meeting to order at 5:30 PM. Minutes: Member Dawson moved to approve the minutes of January 4, 2023. The motion was seconded by Member Halstead and approved unanimously. Chairman Watwood welcomed Kim Burch as the new member of Planning & Zoning. She has filled the seat vacated by Shauna Smith. Mayor Ferrelle addressed the committee and updated them on the Moores Grove project. J.W. York will present a revised plan and present to P&Z in March 2023. Old Business: 1) Laura Gresham Bivins, 280 Bentwood Trail, 18 x 20 ft pole barn behind her house. Chairman Watwood visited the site. He determined since it is in the back yard of the house, and it was determined would only need to be 10 ft off the property line. It is still not clear exactly where the property line lies. Neither property owner or the adjoining neighbor has a recent survey. It is a stick-built structure with a metal roof. Member Dawson moved approve as it stands. The motion was seconded by Member Field and approved unanimously. New Business: 1) Margaret Wagner, 130 Winter Hill Drive, Re-build. Having reviewed the plans presented to the committee, Member Halstead moved approve. The motion was seconded by Member Field and approved unanimously. 2) Tim Wilkes RLS: Moon and Spaulding property reconfiguration. Having submitted an application and new survey plats, Member Dawson moved to approve the lot combination of 145 Peachtree and 244 Main Street, as presented from 3 lots into 2 lots. The motion was seconded by Member Burch and approved unanimously. 3) Dan Miller, Re-Fined Pallet, LLC, Business License Application. Member Field moved to approve the business license application as presented. The motion was seconded by Member Dawson and approved unanimously. 4) Keri Valentine, Valentine Studio, LLC, Business License Application. Member Burch moved to approve the business license application as presented. The motion was seconded by Member Halstead and approved unanimously. Having no further business, the meeting adjourned at 6:10 PM.

Members Present: Kim Burch, Chairperson Andy Dawson Collin Field James Tucker Russell Cochran Regular Meeting: Mayor Ferrelle called the meeting to order at 5:30 p.m. James Tucker and Russell Cochran were appointed by Mayor and Council as new members to the Planning and Zoning Commission. Since the resignation of David Watwood, Member Field nominated Kim Burch to fill the position as Chair of the Committee. Member Tucker seconded the motion and all votes were in favor. Member Tucker moved to nominate Andy Dawson as Vice-Chair, seconded by Member Cochran and approved unanimously. Minutes: Member Dawson moved to approve the minutes of February 6, 2023. (There were no minutes for the March 6, 2023 meeting due to no quorum. The motion was seconded by Member Tucker and approved unanimously. Old Business: None. New Business: 1. Bryan Flaig, 280 Smithonia Road, Interior Remodel. Member Field moved to approve the application as submitted. The motion was seconded by Member Dawson and approved unanimously. 2. Business License Application, Garfias Mexican Restaurant. Member Field moved to approve and recommend approval to Mayor and Council the business license application for Garfias Mexican Restaurant. The motion was seconded by Member Tucker and approved unanimously. 3. Six Mile Station plans were discussed but no action was taken. Having no further business, the meeting adjourned at 6:15 p.m.

The motion was seconded by Member Tucker and approved unanimously. Old Business: None. New Business: 1. Janice Raiford was not in attendance but had asked Clerk Bond a question regarding putting a storage building behind the Markets of Winterville building. Due to issues of safety and set-backs, making it unfeasible, Member Field moved to deny any application for such a request. The motion was seconded by Member Dawson and denied unanimously. 2. Nathaniel and Christi Sedlacek, 3000 Hickory Lane, submitted plans and an application for a detached building/barn for RV storage. Having met all requirements and setbacks, Member Dawson moved to approve as submitted. The motion was seconded by Member Cochran and approved unanimously. 3. Marion and Sharon Kenneybrew, 1025 Moores Grove Road, submitted an incomplete application for enclosing a deck. Since they have not responded to any emails and were not in attendance, no action was taken. 4. Business License Application, GoHam’s Kicks. Vida Jefferies submitted a business license application for a new business at 225 Cherokee Road, Unit #3. His initial business applied for was for a retail shoe store, food and car detailing. He had been serving food but was told by the ACC Health Department this is not allowable until he can meet the requirements of a restaurant. Member Dawson moved to approve and recommend approval to Mayor and Council for his business as a retail store but no detailing of vehicles would be allowed or serving of food. The motion was seconded by Member Field and approved unanimously. Having no further business, the meeting adjourned at 6:00 p.m.

Regular Meeting – Minutes May 9, 2023 The Mayor and City Council held the regular City Council meeting on Tuesday, May 9, 2023 at 6:00 p.m. at Winterville City Hall. The meeting was streamed live via YouTube. Mayor Ferrelle called the meeting to order at 6:00 p.m. Also present were Councilpersons, Melissa Metzger, Bruce Johnson, Amanda Mooney (attended via Zoom), City Attorney, David Ellison, and Municipal City Clerk Wendy Bond. The Pledge of Allegiance was recited. Approval of Minutes: Councilperson Metzger moved to accept the regular minutes of April 11, 2023 and the as presented. Councilperson Metzger moved to adopt the Comprehensive Plan Update Resolution as presented. The motion was seconded by Councilperson Johnson and approved unanimously. The Second Item of New Business: Elevator Project Winterville Community Center. Councilperson Johnson moved to award the Community Center elevator project to Fairway Elevator Company. The total contract totals $91,277.00 to be paid from SPLOST 2020 funds. Seventy-Five Thousand Dollars ($75,000.00) will be reimbursed by the Georgia Council for the Arts Cultural Facilities Grant. The motion was seconded by Councilperson Metzger and approved unanimously. The Third Item of New Business: Police Truck light bar. Councilperson Metzger moved to approve up to $1400 in general funds to purchase and replace the light bar on the Ram police truck. The motion was seconded by Councilperson Mooney and approved unanimously. The Fourth Item of New Business: WPD Bike Patrol Equipment. Councilperson Metzger moved to approve up to $2,000 in ARPA Funds to purchase a bicycle and equipment for the new bike officer, Kristy Dassow Reed. The motion was seconded by Johnson and approved unanimously. The Fifth Item of New Business: B&B Ordinance and Taxes. Councilperson Johnson moved to table this item until the June meeting. Councilperson Johnson moved to award the bid of $5,000 in ARPA funds for an architect, to Brandied History for the Blacksmith Shop building. The Mayor and City Council held the regular City Council meeting on Tuesday, June 13, 2023 at 6:00 p.m. at Winterville City Hall. The meeting was not live streamed due to technical issues. Mayor Ferrelle called the meeting to order at 6:00 p.m. Also present were Councilpersons, Melissa Metzger, Bruce Johnson, Amanda Mooney, City Attorney, David Ellison, and Municipal City Clerk Wendy Bond. The Pledge of Allegiance was recited. Approval of Minutes: Councilperson Metzger moved to accept the regular minutes of May 9, 2023 and the as presented. The motion was seconded by Councilperson Mooney and the minutes were approved unanimously. Unfinished Business: The First Item of Unfinished Business: Six Mile Station Lot Combination. Having held the Public Hearing on Tuesday, June 6, 2023, Councilperson Johnson moved to approve the rezoning of property located at 145 Cherokee Road, County Parcel # 283 A4 F015 from C-1 to C-PD (Commercial - Planned Development) and 485 N Main Street 283A4 F012 from R-15H to C-PD (Commercial - Planned Development). The motion was seconded by Councilperson Metzger and approved unanimously. The Second Item of Unfinished Business: Public Safety Meds/Supplies. Councilperson Mooney moved to deny a motion for the Winterville Volunteer Fire Department to carry and/or furnish certain medications until further information is discussed. Councilperson Johnson moved to approve up to $8,140 in SPLOST 2020 Funds to for labor and materials in the electrical room in preparation of the elevator. (This funding will go toward the elevator grant match.) The motion was, seconded by Mooney and approved unanimously. The Fifth Item of New Business: Playscape/Playground Repairs. The playground in Pittard Park is in need of repairs to replace the rubber matting due to wear and tear. Josh Koons may be able to assist the city with researching materials. The Sixth Item of New Business: Winterville Police Department Repairs. Councilperson Mooney moved to approve up to $4,500 in ARPA funds to replace the floor covering and repair and paint an office in the WPD. The motion was seconded by Councilperson Metzger and approved unanimously. The Seventh Item of New Business: Winterville Police Department Tasers. Councilperson Metzger moved to approve up to $2,100 in SPLOST 2020 funds for new tasers for the WPD. The motion was seconded by Councilperson Johnson and approved unanimously. The Eighth Item of New Business: B&B Ordinance Revision. Councilperson Metzger moved to approve the revised Bed & Breakfast Ordinance as presented by Attorney Ellison. A tentative millage rate has been set and the Public Hearings have been scheduled for Monday, July 3, 2023, 5:00 p.m., July 11, 2023, 11:00 a.m. and 6:00 p.m. They are scheduled for advertisement in the local newspaper for June 16, 2023 as required by law. The Twelfth Item of New Business. Budget Meetings. Mayor Ferrelle will be scheduling meetings with the department heads soon for the 2024 budget. Mayor Ferrelle called for a vote to amend the agenda adding two additional items. Councilperson Metzger moved to amend the agenda as requested. The motion was seconded by Councilperson Mooney and approved unanimously. The Thirteenth Item of New Business: Elevator shaft masonry. Councilperson Mooney moved to approve up to $5,370 in SPLOST 2020 funds for brickwork and masonry in the elevator shaft of the Cultural Center. The motion was seconded by Councilperson Metzger and approved unanimously. There will be more costs later to complete the drywall in the ceiling of the shaft. The Fourteenth Item of New Business: Historic Resources Survey. Councilperson Metzger moved to approve a Historic Resource Survey, for a proposal submitted by John and Amy Kissane, as recommended by the HPC. It will grant funded. Mayor Ferrelle opened the public hearing at 6:00 p.m. Also present were Councilpersons Melissa Metzger, Amanda Mooney, Bruce Johnson and City Clerk Wendy Bond. In accordance with the requirements of O.C.G.A. 36-66-1 the ‘Zoning Procedures Law’, the Mayor and Council of the City of Winterville, Georgia held a Public Hearing on Tuesday June 6, 2023 at 6:00 pm at Winterville City Hall, 125 N Church Street, in Winterville. The purpose of the Public Hearing was to receive public input for the rezoning of property located at 145 Cherokee Road, County Parcel # 283 A4 F015 from C-1 to C-PD (Commercial - Planned Development) and 485 N Main Street 283A4 F012 from R-15H to C-PD (Commercial - Planned Development). All interested parties wishing to address the Mayor and City Council about the proposed amendment were required to sign up to speak in advance of the hearing. Josh Koons, Koons Environmental Design gave an overview of the changes made to meet zoning requirements and requests. Having no public sign up to speak Mayor Ferrelle closed the meeting at 6:10 p.m.

Each year, the board of tax assessors is required to review the assessed value for property tax purposes of taxable property in the city. When the trend of prices on properties that have recently sold in the city indicate there has been an increase in the fair market value of any specific property, the board of tax assessors is required by law to re-determine the value of such property and increase the assessment. This is called a reassessment. When the total digest of taxable property is prepared, Georgia Law requires that a rollback millage rate must be computed that will produce the same total revenue on the current year’s new digest that last year’s millage rate would have produced had no reassessments occurred. The budget tentatively adopted by the City of Winterville requires a millage rate higher than the rollback millage rate. Therefore, before the City of Winterville may finalize the tentative budget and set a final millage rate, Georgia Law requires that three public hearings be held to allow the public an opportunity to express their opinions on this increase. All concerned citizens are invited to the public hearings on this tax increase to be held at the following locations at the indicated times: All public hearings will be held at the Winterville City Hall, 125 N.
